  • Buyer as Client: Tidy Mart exist exclusively (where a brokerage firm chooses to only represent buyers and never sellers, as an exclusive buyer agent) or, in a full service company, by offering buyer agency to buyers who become clients. Buyers would have to agree to some form of dual agency in the event that they wished to buy their products need, which that company has listed for procure and for which it represents the seller.

  • At this point, Tidy Mart owes the Buyers duties of:
  • Loyalty to the buyer by acting in the buyer's best interest
  • Confidentiality by not disclosing facts that could influence the buyer's ability to negotiate the best terms.
  • Disclosure to other parties in the transaction that the licensee has been engaged as a buyer's agent.
  • The broker negotiates price and terms on behalf of the buyers and prepares standard purchase contract by filling in the blanks in the contract form. Tidy Mart acts as a fiduciary for the buyer.
  • Seller as Client: Tidy Mart exist exclusively (where a brokerage firm chooses to only represent Sellers and never Buyers, as an exclusive Seller agent) or, in a full service company, by offering seller agency to seller who become clients. Seller would have to agree to some form of dual agency in the event that they wished to sell their products, which that company has listed for selling and for which it represents the buyer.

  • At this point, Tidy Mart owes the Sellers duties of:
  • Loyalty to the Seller by acting in the Sellers best interest.
  • Confidentiality by not disclosing facts that could influence the seller's ability to negotiate the best terms.
  • Disclosure to other parties in the transaction that the licensee has been engaged as a seller's agent.
  • The broker negotiates price and terms on behalf of the Sellers and prepares standard Selling contract by filling in the blanks in the contract form. Tidy Mart acts as a fiduciary for the Seller.
